You may use the Website for lawful purposes only. You agree not to:
Use the Website in any way that violates applicable law or these Terms;

Availability. We may modify, suspend, or discontinue any part of the Website or our services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, downtime, or discontinuation of the Website.
Accuracy and errors. We work to keep Website content — including class schedules, descriptions, availability, and pricing — accurate and current, but we do not warrant that it is complete, accurate, or error-free, and content may become outdated. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. If a class, product, or offer is listed at an incorrect price or with incorrect information due to an error, we reserve the right to cancel or refuse any registration or order placed for it, even after a confirmation has been sent.
Third-party links. The Website may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site, and links do not constitute our endorsement.
5. Intellectual Property
All content on the Website — including text, images, logos, course materials, designs, and the "The Potter's Hands Studio" name and branding — is owned by the Studio or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
Your artwork: You retain ownership of the original pottery pieces you create in our classes. By participating, however, you grant the Studio permission to display, photograph, and share images of pieces made in our studio for promotional and educational purposes, unless you opt out in writing (see Section 13).
6. Class Registration and Booking
Class and workshop registration is completed through the Website or another method we designate. A registration is confirmed only once payment is received and you receive a confirmation from us. Spots are limited and offered on a first-come, first-served basis. We reserve the right to refuse or cancel any registration at our discretion.
7. Payment and Fees
All fees are listed in [CURRENCY, e.g., U.S. dollars] and are due at the time of booking unless otherwise stated.
Prices are subject to change, but changes will not affect classes you have already paid for.
You are responsible for any applicable taxes.
We accept the following payment methods: [LIST PAYMENT METHODS].
8. Refund, Cancellation, and No-Show Policy
All sales are final. All payments for classes, workshops, studio time, events, deposits, packages, memberships, materials, and firing fees are non-refundable, except where a refund is required by applicable law or expressly stated below. By completing your purchase, you acknowledge and agree to this policy.
Studio credit as a courtesy. Although payments are non-refundable, we may, at our sole discretion, offer studio credit (not a cash refund) when you cancel with at least 14 days notice before the class start date. Studio credit is valid for 12 months, is non-transferable, has no cash value, and may be used toward future classes or workshops, subject to availability. Granting credit in one instance does not obligate us to do so again.
Late cancellations and no-shows. Cancellations made with less than 14 days notice, failure to attend ("no-shows"), and arriving too late to safely participate are forfeited in full, with no refund, credit, or make-up session.
Missed sessions in multi-week courses. Multi-week courses are priced as a complete program. Missing one or more sessions does not entitle you to a refund, credit, make-up class, or proration.
Deposits. Any deposit is non-refundable and reserves your spot; it is forfeited if you cancel or fail to attend.
Packages, memberships, and gift cards. These are non-refundable and non-transferable, expire on the stated date, and have no cash value except where required by law. Unused sessions are forfeited at expiration.
Materials and firing fees. Once materials have been issued or a piece has entered the firing process, the associated fees are non-refundable, regardless of the outcome of the firing.
Cancellation by the Studio. If we cancel a class or session (for example, due to low enrollment, instructor unavailability, equipment failure, weather, or other circumstances), we will offer you, at our discretion, a transfer to another class, studio credit, or a refund of the amount paid for the cancelled session. This is the full extent of our liability for a cancelled class, and we are not responsible for any related costs you may incur (such as travel or supplies).
Medical or emergency situations. We are not obligated to provide refunds for missed classes due to illness, injury, or personal emergencies. At our discretion, and with reasonable documentation, we may offer studio credit as a one-time courtesy.
Chargebacks. You agree to contact us first to resolve any billing concern. Initiating a chargeback or payment dispute for a charge that is valid under this policy is a breach of these Terms; we reserve the right to contest the dispute, recover related fees, and refuse future service.
Discretionary exceptions. Any exception we make to this policy is a one-time courtesy granted at our sole discretion and does not waive this policy or set a precedent for future requests.
9. Class Packages, Memberships, and Gift Cards
[INCLUDE THIS SECTION ONLY IF APPLICABLE.] Multi-class packages, memberships, and gift cards are subject to the following: they are [non-refundable / non-transferable], expire 12 months (1 year) from the date of purchase, and have no cash value except where required by law. Unused sessions are forfeited at expiration.
10. Studio Rules and Code of Conduct
For everyone's safety and enjoyment, participants agree to:
Follow all instructor directions and posted studio rules;
Use tools, equipment, kilns, and materials only as instructed;
Wear appropriate clothing and closed-toe shoes; tie back long hair;
Clean their workspace and tools after use;
Treat staff, instructors, and other participants with respect.
We reserve the right to remove any participant who behaves unsafely, disruptively, or disrespectfully, without refund.
11. Health, Safety, and Assumption of Risk
Working with clay and ceramics involves inherent risks. These include, without limitation: exposure to clay dust and silica, contact with glazes and chemicals, use of sharp or pointed tools, operation of pottery wheels, lifting, repetitive motion, and the high temperatures of kilns and fired pieces.
You acknowledge that you are voluntarily participating with knowledge of these risks and that you are physically able to participate. You agree to disclose any health conditions, allergies, or pregnancy that may affect your safe participation, and to follow all safety instructions. Participation in classes also requires a separately signed liability waiver.
12. Release and Limitation of Liability
To the fullest extent permitted by law, you agree that the Studio, its owners, instructors, employees, and agents are not liable for any injury, loss, or damage arising from your participation in classes or use of our facilities, except where caused by our gross negligence or willful misconduct. This Website-based release does not supersede any separately signed waiver, which controls in the event of a conflict.
Our total liability for any claim relating to the Website, a class, or a product will not exceed the amount you paid to us for the specific class or product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. [STATE LAW MAY LIMIT THE ENFORCEABILITY OF THESE PROVISIONS — ATTORNEY REVIEW RECOMMENDED.]
13. Photography, Media, and Promotional Release
We may photograph, film, or record classes, events, participants, and finished pieces, and you grant us a perpetual, worldwide, royalty-free, irrevocable license to use your likeness, image, voice, first name, and artwork in any media — including our Website, social media, online and paid advertising, email campaigns, and printed promotional materials — without further notice, approval, or compensation. You waive any right to inspect or approve the finished materials. If you do not wish to be included, you must notify us in writing at thepottershandsstudio@gmail.com before your class or event, and we will make reasonable efforts to honor your request going forward.
14. Firing and Finished Pieces
Ceramics is an unpredictable medium. While we take care in firing and glazing, we cannot guarantee the outcome of any piece. Pieces may crack, warp, break, or explode during firing, and glaze results may vary. We are not responsible for damage to or loss of pieces during the firing process.
Finished pieces must be picked up within 60 days of their final firing. Pieces not collected within 60 days of final firing may be considered abandoned and disposed of at our discretion.
15. Personal Property
You are responsible for your own belongings. The Studio is not responsible for lost, stolen, or damaged personal property brought onto the premises.
16. Products and Online Shop
[INCLUDE ONLY IF YOU SELL PRODUCTS ONLINE.] Product descriptions and pricing are provided as accurately as possible but may contain errors, which we may correct at any time. [DESCRIBE SHIPPING, RETURN, AND REFUND POLICY FOR PHYSICAL PRODUCTS — note these often differ from class refund rules.]
17. Promotions, Discounts, and Advertised Offers
From time to time we may advertise promotions, discounts, sales, gift-card offers, referral rewards, giveaways, or promotional codes through the Website, email, text message, social media, or paid advertising. All such offers:
Are offered at our sole discretion, for a limited time, and only while available or until the stated expiration;
Are subject to any specific terms stated with the offer at the time it is presented, which control if they conflict with these Terms;
May not be combined with other offers unless we expressly say so, are limited to one per customer unless stated otherwise, have no cash value, and are not redeemable for cash;
May be modified, suspended, reissued, or cancelled by us at any time without notice; and
Are void where prohibited and subject to all applicable laws.
Advertised offers are subject to availability. We are not responsible for typographical, photographic, or pricing errors in any advertisement or promotion, and we reserve the right to correct such errors and to refuse, modify, or cancel any offer or any registration or order based on inaccurate or erroneous information, even after it has been submitted or confirmed.
18. Email and Text Message (SMS) Marketing
When you provide your email address or mobile phone number and opt in, you consent to receive communications from us, which may include transactional messages (such as booking confirmations and class reminders) and marketing or promotional messages.
Text messages (SMS/MMS). By opting in, you agree to receive recurring automated promotional and transactional text messages from or on behalf of the Studio at the mobile number you provide. Consent is not a condition of purchasing any goods or services. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP, and you can reply HELP for help. We are not liable for any delayed or undelivered messages, as delivery depends on your carrier. You confirm that the number you provide is your own (or that you are authorized to use it) and you agree to notify us if it changes.
Email. You may unsubscribe from marketing emails at any time using the unsubscribe link in any such email. We will handle email marketing consistent with applicable law.
[FOR SMS, YOU MUST USE A SEPARATE, CLEARLY LABELED OPT-IN (e.g., an unchecked checkbox) AT SIGN-UP. CONSULT YOUR ATTORNEY AND YOUR SMS PROVIDER ABOUT TCPA COMPLIANCE.]
19. Reviews, Testimonials, and User-Generated Content
If you submit a review, comment, photo, video, social media post, tag, or other content to us or about us ("User Content"), you grant the Studio a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, display, and distribute that User Content for any purpose, including marketing and advertising on our Website, social media, and other channels. You represent that you own or have the rights to the User Content, that it is accurate, and that it does not violate any law or third-party right, and you waive any moral rights in it.
We may use testimonials and reviews in our advertising. Individual experiences and results described in testimonials are personal to those individuals and are not a guarantee that you will have the same experience or result. We may, but are not obligated to, monitor, edit, or remove User Content, and we are not responsible for User Content posted by others.
20. Privacy
Your use of the Website and our services is also governed by our Privacy Policy, available at thepottershandsstudio.com/privacy-policy, which explains how we collect, use, and protect your information.
21. Disclaimers
The Website, our classes, and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure.
We do not warrant or guarantee that any class or instruction will result in any particular skill level, artistic outcome, or other result. Statements made in our advertising, promotional materials, and on social media are for general informational purposes, are not guarantees, and are subject to change.
We are not responsible for the acts, omissions, content, or availability of third-party platforms or providers we use or link to, including social media platforms, payment processors, scheduling or booking tools, email and text-messaging providers, and advertising networks.
22. Indemnification
You agree to indemnify and hold harmless the Studio and its owners, instructors, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Website or our services.
23. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Lafayette County, Mississippi, and you consent to that jurisdiction. [SOME STUDIOS PREFER MANDATORY ARBITRATION OR MEDIATION — DISCUSS WITH YOUR ATTORNEY.]
24. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Your continued use of the Website or our services after changes are posted constitutes acceptance of the revised Terms.
25. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
